CONTENT
StormWatch+ ("Service"), offered by and Cirrus Weather Solutions ("CWS"), distributes weather watches, warnings, and advisories (“Alerts”) issued by the National Weather Service to registered users. Information is deemed timely, accurate, complete, and reliable, but is not guaranteed as such.
TERMS OF USE
This Service is offered to you conditioned upon your acceptance without modification of the terms, conditions, and notices contained herein. Installation and/or use of this Service implies acceptance of all such terms, conditions, and notices. If you do not agree to these terms, do not use the Service.
LOCATION-BASED SERVICES
Given that the Service is location-based, the user will be required to register one or more physical locations with the Service, which are sent to the Service's secure database for storage. The user's current location may be automatically determined using GPS data, however disclosure of user's location is at the user's discretion and at no time is the user "tracked" using their GPS location.
INTERRUPTION OF SERVICE AND SOLE SOURCE
By agreeing to these Terms, the user understands that, due to factors beyond CWS’s control, an interruption in service may occur or Alerts may not be timely in their issuance or receipt. CWS will not be held liable for these or other events that prevent or delay data transmission and is not bound to provide User any monetary or in-kind reimbursement should an interruption in service take place. StormWatch+ Alerts should not be used as a sole source of information regarding the weather event. Never base critical decisions on this, or any, weather information obtained from the Internet or other electronic means.
ADDITIONAL FEES
In addition to any fees paid to CWS for the Service, your cellular carrier may charge data service fees. Retransmission, redistribution, reselling, or reverse engineering of the Service is a violation of the Terms of Use and will result in immediate cancellation of the Service with no refund.
LIMITATION OF LIABILITY
CWS hereby disclaims all warranties and conditions with regard to the Service including all implied warranties and conditions of merchantability and fitness for a particular purpose. There are no warranties which extend beyond the description on the face hereof. CWS does not warrant against damages or defects arising out of use of the Service. No warranty of any kind, expressed or implied, is made regarding the safety of this Service.
To the extent allowed by law, CWS shall not be held liable for any direct, indirect, punitive, incidental, special or consequential damages arising out of, or connected with, the use or misuse of this Service. User assumes all risks and liability arising from use of this Service.
APPLICABLE LAW
This agreement is governed by the laws of the state of Tennessee. You hereby consent to the exclusive jurisdiction and venue of the courts of Tennessee, in all disputes arising out of or relating to the use of this Service.
